The medical profession owes a ‘duty of care’ to patients. This is a duty to ensure that patients receive proper treatment, in the proper manner.
If this duty is not met and the person being treated suffers in any way as a result, the victim has a potential claim. In this situation it needs to be established whether the action taken, or not taken, was reasonable in the circumstances.
Breach of duty may be due to the care provider providing an incorrect diagnosis, failing to provide a diagnosis, incorrect administration of medication or even a failure to take proper care for the patient's safety while in their care.
